USA exhibition visitors

These terms and conditions (these “T&Cs”) are to be read in conjunction with the Registration Form which, together, represent the entire agreement between you and Applied Market Information LLC, on behalf of itself and its affiliate, Applied Market Information Ltd (together, AMI, us or we). By completing and submitting the Registration Form, you agreed to be bound by these T&Cs. You acknowledge and agree that these T&Cs apply to the exhibition as well as to any separately ticketed events related thereto, including, without limitation, any networking events, dinner events, etc. (each an “Event”).

  1. On rare occasions we may have to cancel, postpone or relocate an exhibition and/or Event. We will endeavour to give you as much notice as possible and we will not be liable for any losses incurred by you as a result of any cancellation, postponement or relocation.

  2. Personal arrangements, including, without limitation, travel and accommodation relating to the exhibition and/or any event are your responsibility and in no event shall AMI or the venue be liable for any expenditures made by you, including in the event of any cancellation, postponement or relocation by us of the exhibition and/or Event.

  3. We cannot ensure the security of items left unattended. You acknowledge and agree that we accept no liability or responsibility for loss or damage to property (including, without limitation, loss of any belongings) sustained by you at the exhibition and/or Event.

  4. You must at all times behave in a professional and appropriate manner at our events. This includes, but is not limited to, trying to exhibit without registering as an Exhibitor, marketing your business without registering as an Exhibitor, bad behaviour, protest or intoxication.

  5. AMI has sole control over admission policies at all times. AMI reserves the right to exclude or remove from the Event any person whose presence or behaviour it reasonably considers to be undesirable or potentially unlawful, harmful, disrespectful or disruptive. Participants asked to stop any harassing behaviour or requested to leave, are expected to comply immediately.

  6. You are solely and fully responsible for your conduct resulting from your consumption of alcohol at any event, and if you do consume alcohol, you agree to drink responsibly. You will not consume alcohol if you are younger than the applicable legal age for such activity. We reserve the right, in our sole discretion, to deny alcoholic beverage service to any person who appears to be intoxicated or for any other reason in our sole discretion.

  7. No smoking of any kind (including any electronic cigarettes, vaporizers, or similar products) will be permitted in the exhibition or any Event at any time.

  8. Proper attire (including, without limitation, shoes) must be worn at all times. You agree to wear attire that is not distracting or offensive to others.

  9. You may not photograph, tag or otherwise discuss on any social media platform any person at the exhibition or any Event without such person’s permission.

  10. All bags and other items may be subject to screening/security checks. We reserve the right not to allow any bag, parcel or other item into the exhibition and/or any Event.

  11. Badges, tickets and other credentials are non-transferable, non-exchangeable, non-refundable, revocable and void if altered.

  12. You may not: (i) perform any activity or cause or permit anything that is reasonably likely to be disruptive or dangerous to AMI, any exhibitor, sponsor, other any other attendee, (ii) conduct or pursue any illegal or offensive activities, (iii) bring any firearms, ammunition, weapons of any kind, or any other offensive, dangerous, flammable or explosive, hazardous or inherently dangerous materials into the exhibition or any Event, or (vi) bring illegal drugs into the exhibition or any Event.

  13. You agree that by choosing to allow your badge to be scanned by one or more exhibitor(s) or sponsor(s) or at a theatre within the exhibition or any Event, you are providing such exhibitor(s) or sponsor(s) (or in the case of a theatre, the sponsor(s) of such theatre) ("Receiving Participants") with the information, including your personal data, which you provided on or through the Registration Form or any related forms completed at the time of registration ("Registration Data"). By allowing your badge to be scanned, you: (i) specifically consent to: (a) the receipt and collection of your Registration Data by the Receiving Participants; (b) the Receiving Participants using your Registration Data to contact you regarding their products or services; and (c) the transfer or other processing of your Registration Data both within and outside the United States by the Receiving Participants; (ii) authorize and direct AMI to transfer or otherwise make available an electronic copy of your Registration Data to the Receiving Participants (the "Transfer"); and (iii) acknowledge that the Transfer of any Registration Data may constitute a "sale" of your personal data within the meaning of applicable data privacy laws. AMI is not responsible for the processing of your personal data (including Registration Data) by any third party (including Receiving Participants). Please review the applicable privacy policies of such Receiving Participants to understand how they may process your personal data and how to exercise any rights you may have with respect to personal data you provide to them.

  14. You also understand and agree that your Registration Data may be held and used by AMI and any third party acting on its behalf, in order to run the exhibition and/or any Event and for analyzing visitor traffic with a view to improving the exhibition and/or Event experience (for this exhibition and related Events and for future exhibitions and related Events) for visitors, exhibitors, sponsors and others. AMI may also process your Registration Data in accordance with our Privacy Policy then in effect, a current copy of which can be accessed at https://www.amiplastics.com/privacy-policy. You acknowledge and agree that AMI (and/or any third party acting on its behalf) may transfer and process your Registration Data outside of the United States for these purposes and you consent to such transfer of your Registration Data.

  15. You acknowledge and agree that AMI or its representative or affiliates will be taking photos and recording video, including interviews, at the exhibition and any Event (the “Recordings”). By attending the exhibition and/or any Event, you understand and grant permission to AMI and its affiliates (a) to make such Recordings; (b) the right to use your name, image, likeness and/or voice, biographic information (if provided by you), performance and/or opinions included in the Recordings to promote, exploit, exhibit and/or distribute any such content throughout the world in any manner whatsoever, in whole or in part, including in any and all social media, online marketing, printed materials, news, commercial, promotional, packaging for any product or service, in any case without payment of any fee or other compensation to you. You further acknowledge and agree that AMI shall own all rights, title and interest in and to the Recordings and any reproductions thereof and shall have the unrestricted right to publish, edit, combine your Recordings with the Recordings of others, and to edit, modify and otherwise distribute such Recordings. If you do not want your image to be used during filming at the Exhibition, you need to send a request to AMI’s Exhibition Manager.

  16. We ask you to be aware of, and at all times comply with, all applicable laws, including, without limitation, antitrust laws.

  17. We may change and update these T&Cs from time to time without notice. Please visit https://www.amiplastics.com/terms-and-conditions-USA-exhibition-visitors from time to time to review the current version of these T&Cs.

  18. Class Action Waiver. Any proceeding to resolve or litigate any dispute in any forum will be conducted solely on an individual basis. Neither you nor we will seek to have any dispute heard as a class action or in any other proceeding in which either party acts or proposes to act in a representative capacity. No proceeding will be combined with another without the prior written consent of all parties to all affected proceedings. You and we also agree not to participate in claims brought in a private attorney general or representative capacity, or any consolidated claims involving another person's account, if we are a party to the proceeding. YOU ARE GIVING UP YOUR RIGHT TO PARTICIPATE AS A CLASS REPRESENTATIVE OR CLASS MEMBER ON ANY CLASS CLAIM YOU MAY HAVE AGAINST US INCLUDING ANY RIGHT TO CLASS ARBITRATION OR ANY CONSOLIDATION OF INDIVIDUAL ARBITRATIONS.

  19. These T&Cs are governed by and construed in accordance with the law of the State of Delaware, without regard to conflicts of law principles.

  20. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, (A) AMI SHALL NOT BE LIABLE, WHETHER BASED ON A CLAIM IN CONTRACT, TORT (INCLUDING NEGLIGENCE), BREACH OF STATUTORY DUTY OR OTHERWISE ARISING OUT OF OR IN RELATION TO THESE T&CS, FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR LOST PROFITS, EVEN IF AMI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (B)THE TOTAL AGGREGATE LIABILITY OF AMI, WHETHER BASED ON AN ACTION OR CLAIM IN CONTRACT, TORT (INCLUDING NEGLIGENCE), BREACH OF STATUTORY DUTY OR OTHERWISE ARISING OUT OF, OR IN RELATION TO THESE T&CS SHALL NOT EXCEED THE TOTAL AMOUNT OF THE FEE PAID BY YOU FOR ADMISSION TO THE EXHIBITION AND ANY EVENT.
